Article I.

Introductory Provisions

1. These General Terms and Conditions govern the concept of the rules for the use of the PortDeBras^TM exercise method, which must be observed.
2. PortDeBras^TM is a method based on functional and dynamic stretching, combined hand work. It is offered as a restorative and rehabilitation activity, including for the back. Develops joint mobility, muscle strength and flexibility, movement skills and techniques. The ability to harmoniously and fully use the body’s ability to move.

Article II.

Distribution

1. PortDeBras^TM club system is not allowed to be distributed. This authorization is only granted to the official distributors for each country, which are:

• Slovakia: Helena Balová,
• Czech Republic: Iva Mojžíšková, Lucie Dedičová,
• France: Beatrix de Montalier,
• Bulgaria: Irina Atanasova,
• Switzerland: Oxana Altenburger.
• Israel: Assol Rosenberg

2. PortDeBras^TM club system will be made available to its members by sending login credentials to their own user accounts. It is forbidden to disclose these login details to third parties or to disseminate them in any other way.
3. In the case of unauthorized distribution of PortDeBrasT^M club system, there is an unauthorized interference with copyright, which gives rise to the right to judicial protection.

Article III.

Official logo

1. The official PortDeBras^TM logo may not be placed on products used for commercial purposes without the prior consent of the authorized person, who is Olga Snezhik.
2. If interested in placing the logo on clothing, you must send this proposal in advance to Olga Snezhik for approval.
3. In the event of unauthorised use of the logo or failure to comply with the obligations under clauses 1 and 3 of this article, there shall be unauthorised interference with copyright, thereby giving rise to a right to judicial protection.

Article IV.

Courses

1. Trainers who intend to give certified courses need official approval prior the course. Trainers are required, for official approval, to submit a video demonstrating the correct performance of the basic movement sequence of the course.
2. In the event of failure to comply with the obligation under clause 1 of this article, the trainer may not conduct the certified course.
3. Sequences that cannot be used in commercial courses come from the following courses:

• „PortDeBras™ Introduction Course,
• „PortDeBras™ Basic” Course – Level 1,
• „PortDeBras™ Intermediate” Course – Level 2,
• “PortDeBras™ Progression“ Course – Level 3,
• „PortDeBras™ Exercise“ Course – Level 4.

4. The use of the following sequences from the courses referred to in clause 3 of this article constitute an unauthorized interference with copyright, thereby giving rise to a right to judicial protection

Article V.

Certificates

1. Certificates may only be issued by the person who has the official approval referred to in clause 1 of Article IV.
2. The layout of certificates must always be approved in advance by the authorized person, who is Vladimir Sniezhik.

Article VI.

Trainer

1. A trainer may achieve any of the following trainer statuses:

• PortDeBras™ Instructor,
• PortDeBras™ Trainer,
• PortDeBras™ Master Trainer,
• PortDeBras™ Elite Trainer,
• PortDeBras™ Expert.

2. A trainer who does not qualify for one of the trainer statuses referred in point 1 of Article VII. of these General Terms and Conditions may not act as a trainer in that status.
3. In the event that a trainer exercises any of the trainer statuses referred to in clause 1 of this article, although he does not meet the conditions for this, he shall be liable for any damage caused by this to third parties.

Article VII.

Terms and conditions for the person of the trainer

1. In order to attain the status of trainer referred to in point 1 of Article VI. of these General Terms and Conditions, a person must fulfil the following conditions:

PortDeBras™ Instructor:

• the trainer has obtained a certificate from the PortDeBras™ Basic or PortDeBras™ Introduction workshop or PortDeBras™ Club System workshop,
• the trainer is a member of the PortDeBras™ Club system.

PortDeBras™ Trainer:

• the trainer fulfils the conditions set out in point 1.1 of this Article of the General Terms and Conditions and attends a training course every two years.

PortDeBras™ Master Trainer:

• the trainer has already obtained certificates from the following courses:
• PortDeBras™ BASIC,
• PortDeBras™ INTRODUCTIONS,
• PortDeBras™ INTERMEDIATE,
• PortDeBras™ PROGRESSION,
• BALL,
• BAND,
• ParTerre.
• the trainer is a member of the PortDeBras™ Club system,
• the trainer organises workshops and courses on regular basis,
• PortDeBras™ office decides whether the PortDeBras™ trainer is ready to obtain the certificate of PortDeBras™ Master Trainer.

PortDeBras™ Elite Trainer:

• the trainer has already obtained certificates from the following courses:
• PortDeBras™ BASIC,
• PortDeBras™ INTERMEDIATE,
• PortDeBras™ PROGRESSION,
• PortDeBras™ EXERCISE,
• BALL,
• BAND,
• ParTerre.
• the trainer is a member of the PortDeBras™ Club system,
• the trainer organises workshops and courses on regular basis,
• PortDeBras™ office decides whether the PortDeBras™ trainer is ready to obtain the certificate of PortDeBras™ Elite Trainer.

PortDeBras™ Expert:

• PortDeBras™ office decides whether to awards the PortDeBras™ Expert certificate to the trainer.

2. Trainers who hold one of the certificates referred to in point 1 of Article VI. of these General Terms and Conditions are entitled to:

PortDeBras™ Instructor:

• teach commercial lessons in fitness centres, clubs and other sports facilities,
• teach online commercial lessons only in close non-public groups.

PortDeBras™ Trainer:

• teach commercial lessons in fitness centres, clubs and other sports facilities,
• present the PortDeBras™ method at public commercial and non-commercial events
• give workshops or certified courses after sending a sample video of sequences the trainer completed at the “TRAINER COURSE” course. The trainer receives then additional advice, recommendations and overall feedback. The trainer is informed whether the trainer is allowed to give the intended workshop or course.

PortDeBras™ Master Trainer:

• teach commercial lessons in fitness centres, clubs and other sports facilities,
• present the PortDeBras™ method at public commercial and non-commercial events
• give workshops or certified courses after sending a sample video of sequences the trainer completed at the “TRAINER COURSE” course. The trainer receives then additional advice, recommendations and overall feedback. The trainer is informed whether the trainer is allowed to give the intended workshop or course.

PortDeBras™ Elite Trainer:

• teach commercial lessons in fitness centres, clubs and other sports facilities,
• present the PortDeBras™ method at public commercial and non-commercial events
• give workshops or certified courses after sending a sample video of sequences the trainer completed at the “TRAINER COURSE” course. The trainer receives then additional advice, recommendations and overall feedback. The trainer is informed whether the trainer is allowed to give the intended workshop or course

Article VIII.

Concluding provisions

1. These general terms and conditions may be unilaterally changed.
2. Should any provision of these general terms and conditions be or late become invalid, the legal effect of the remaining provisions of these general terms and conditions shall not be affected. The ineffective provision of these general terms and conditions shall be replaced by a provision which most closely approximates the meaning and purpose of the ineffective provision.
